DMCA Copyright Policy

EnhanceRoom respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement committed using the EnhanceRoom service.

Filing a DMCA Takedown Notice

If you believe that content hosted on or processed through EnhanceRoom infringes your copyright, please submit a written notification containing the following:

  1. A physical or electronic signature of the copyright owner or an authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, with sufficient detail to allow us to locate it on the service.
  4. Your contact information, including name, address, telephone number, and email.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on their behalf.

Counter-Notification Process

If you believe your content was removed in error or is not infringing, you may file a counter-notification. Your counter-notification must include: your physical or electronic signature; identification of the removed material and its prior location; a statement under penalty of perjury that the material was removed by mistake or misidentification; your name, address, and telephone number; and a statement consenting to the jurisdiction of the federal district court for your judicial district (or the Northern District of California if you reside outside the United States) and agreeing to accept service of process from the party who filed the original takedown notice. We will forward counter-notifications to the original complainant and restore material within 10 to 14 business days unless the complainant initiates a court action.

Repeat Infringer Policy

EnhanceRoom maintains a policy of terminating the accounts of users who are determined to be repeat infringers. We may, at our sole discretion, limit access to the service or terminate the account of any user who has been the subject of multiple valid DMCA takedown notices.

All DMCA notices should be sent to our designated copyright agent at dmca@enhanceroom.com. Notices may also be mailed to: EnhanceRoom DMCA Agent, 1234 Commerce Street, Suite 500, San Francisco, CA 94105, United States. Our designated agent is registered with the U.S. Copyright Office as required under 17 U.S.C. § 512(c).

Acceptable Use Policy

Permitted Uses

EnhanceRoom is designed for product photography and listing creation in legitimate online reselling. Permitted uses include:

  • Removing and replacing backgrounds on product photos you own or have rights to.
  • Enhancing product images for listings on eBay, Poshmark, Mercari, and similar marketplaces.
  • Generating AI-powered product descriptions and listing copy for items you are authorized to sell.
  • Using batch processing to prepare inventory photos for your reselling business.
  • Applying AI virtual models and retouching tools to present products accurately.

Prohibited Uses

The following uses of EnhanceRoom are strictly prohibited:

  • Counterfeit goods: Creating or enhancing photos of counterfeit, replica, or knock-off products intended to deceive buyers about authenticity.
  • Trademark infringement: Generating images or listings that misuse trademarks, brand logos, or trade dress without authorization.
  • Misleading photography: Editing photos in ways that materially misrepresent a product's condition, size, color, or features to deceive buyers.
  • Illegal items: Processing images of items that are illegal to sell, including stolen property, regulated substances, weapons (where prohibited), or other contraband.
  • Harassment or abuse: Using the service to create offensive, defamatory, or harassing content targeting individuals or groups.
  • Automated abuse: Scraping, reverse-engineering, or using bots or automated scripts to access the service beyond its intended API and interface.

Content Guidelines

EnhanceRoom's editing tools are powerful, and we expect users to employ them responsibly. All edited product photos must accurately represent the item being sold.

  • Do not use background removal or replacement to hide product defects, damage, stains, or wear.
  • Do not use retouching tools to alter a product's actual condition, such as removing scratches, tears, or discoloration that affect value.
  • Do not use AI-generated backgrounds that imply a false brand affiliation or retail environment to mislead buyers about provenance.
  • AI-generated listing descriptions must not include false claims about condition, materials, origin, or authenticity.
  • Virtual model imagery must not be used to misrepresent garment fit, size, or proportions.

Marketplace platforms have their own photo and listing policies. Users are responsible for ensuring their content complies with the rules of each platform where they list.

Enforcement

EnhanceRoom reserves the right to investigate and take appropriate action against violations of this policy. Enforcement actions may include, but are not limited to:

  • Warning: A written notice identifying the violation and requiring immediate corrective action.
  • Temporary suspension: Restriction of account access for a defined period while a violation is reviewed.
  • Permanent termination: Permanent closure of the account and deletion of associated data for severe or repeated violations.
  • Legal action: Referral to law enforcement or initiation of legal proceedings in cases involving illegal activity.

We may act on reports from third parties, marketplace platforms, rights holders, or our own internal review processes. Users who believe an enforcement action was taken in error may appeal by contacting our support team.

How to Report Violations

If you encounter content or activity on EnhanceRoom that violates this policy, we encourage you to report it. Please include as much detail as possible:

  • A description of the violation and the content or account involved.
  • Any supporting evidence, such as screenshots or URLs.
  • Your contact information so we can follow up if needed.
